Main Objective: 

The main purpose is to during the contract period ensure that the supplier is able to deliver food products in which the added palm oil has not contributed to deforestation and forest degradation of tropical forests and has been produced under sustainable conditions, and/or that the use of palm oil in products is phased out.

 

 

Requirement Specification: 

Suppliers shall have knowledge of which products that are offered contain palm oil, and which products contain palm oil that is regarded as sustainable and has not contributed to deforestation and forest degradation of tropical forests.  

The fact that the products contain palm oil that is regarded as sustainable and has not contributed to deforestation and forest degradation of tropical forests means that it has been produced under conditions that ensure:

  • Protection against the conversion of natural forest and peat marshes
  • Traceability (of the palm oil) back to the specific mill or farm
  • Fair working conditions in accordance with the national and international legislation

 

Documentation of the Requirement Specification: 

Suppliers shall provide an overview of which products offered in the agreed product range and which ingredients for the preparation of food contain palm oil. Suppliers shall also state whether these products contain sustainable palm oil and have not contributed to deforestation and forest degradation of tropical forest (BP), in accordance with the bullet list above. Documentation of this may be certification of the palm oil in accordance with the RSPO scheme (Roundtable for Sustainable Palm Oil), Identity Preserved (IP) or Segregated (SG) levels, or other relevant documentation. It shall also be stated whether the products do not contain sustainable palm oil (P).

Documentation must be made available by [insert date, for example one month after the signing of the contract or start-up]. 

Must be used together with basic/advanced contractual conditions.

 

Information about the Requirement Specification: 

Several food products contain palm oil, such as baked goods, bread and rolls, frozen food, chocolate and ice cream (the Rainforest Fund has prepared a palm oil guide (in Norwegian, opens in new tab) that can provide an overview). These products fall largely under CPV code 15800000. It is relevant to use this contract condition if the procurement relates to these types of products. The requirement can be used both for the procurement of goods and procurement of meal services.

A prerequisite for working with the transition to sustainable palm oil in products is for the supplier to have an overview of which products contain palm oil.

One way to show that the palm oil is sustainable is that it has been certified in accordance with the RSPO scheme (Round Table for Sustainable Palm Oil), Identity Preserved (IP) or Segregated (SG) levels.  The RSPO scheme also encompasses the protection of indigenous peoples and community areas and rights (including the right to free, prior and informed consent).

Follow-up of the requirement during the contract period:

It is recommended that the requirement be followed up during the contract period at status meetings with the supplier. Relevant questions to ask are:

  • What is the reason why some products contain sustainable palm oil and others do not?
  • Are there more products that contain sustainable palm oil now than at the start of the contract?
  • Does the supplier have a plan for transitioning to the use of more products with sustainable palm oil or without palm oil?
